Supreme Court pulls up Kerala government for withholding files from green panel

The Supreme Court has expressed strong disapproval of the Kerala government's reluctance to share information with the Central Empowered Committee (CEC), a statutory body addressing environmental issues. The Court has directed Kerala's Land Revenue Commissioner and the Additional Secretary of the department to appear before it to explain why contempt proceedings should not be initiated against them for allegedly "withholding" files requested by the CEC. This move underscores the Court's concern over the transparency and cooperation required in environmental matters.
The Supreme Court noted that the Central Empowered Committee (CEC), which was originally established by court order, has now received statutory recognition through a notification dated September 5, 2023. This statutory status was granted following directions from the Court. Consequently, the CEC is fulfilling its role to assist the Court in matters related to the TN Godavarman Thirumulpad case.
The Court emphasised that all authorities are obligated to assist the CEC during its inquiries. This requirement underscores the importance of cooperation with the CEC in ensuring effective oversight and investigation in environmental matters.
A bench led by Justice B. R. Gavai expressed strong concerns, stating that withholding an important file undermines the authority of the Court and hinders the Central Empowered Committee (CEC) in performing its role of assisting the Court. The bench emphasised that such actions obstruct the CEC's ability to fulfill its duties effectively.
The bench issued a notice to A. Kowsigan, IAS, Commissioner of Land Revenue, and T. R. Jayapal, Additional Secretary of the Government of Kerala, directed them to appear in court on August 21, 2024. They are required to explain why contempt proceedings should not be initiated against them for allegedly obstructing the Central Empowered Committee's (CEC) investigation.
