Supreme Court halts deportation of Pok-born man, family holding Indian documents

The Supreme Court has temporarily stopped the deportation of a family having Indian passports, Aadhaar cards, and voter IDs. The family was accused of being Pakistani nationals following the Pahalgam terror attack. The court has directed the petitioners to present their case before the relevant authorities.
Ahmed Tariq Butt, the petitioner, is a Bengaluru resident born in Pakistan-occupied Kashmir (PoK). He claimed that his family, who hold valid Indian documents, including passports issued by the Ministry of External Affairs, was being wrongly forced to the Attari Wagah border, even though they are Indian citizens. “We are a total of six members in the same family. Two brothers work in Bangalore. Our parents, sister, and another brother are in Srinagar,” the petitioner said. Tariq Butt's father is from Mirpur in Pakistan-occupied Kashmir, while his mother was born in Srinagar.
As per the petition, Tariq lived in Mirpur until 1997 before crossing over to Srinagar. He spent several years in the Kashmir Valley and now resides in Bengaluru. He earned a management degree from IIM Kozhikode and currently works at an IT firm in Bengaluru. In his application, Butt stated that he and his family hold Indian passports and Aadhaar cards. His family members include his sister Ayesha Tariq and brothers Abubakar Tariq and Umar Tariq Butt. The petition claims that the family lived in Mirpur, although Butt’s place of birth is listed as Srinagar in his passport. The petition further mentions that the Foreigners' Regional Officer (FRO) mistakenly stated that the family entered India in 1997 using Pakistani visas and were expected to leave after their visas expired. Butt denied this, clarifying that they were never Pakistani nationals and never entered India on a visa.
The petition comes after the government's recent order following the Pahalgam terror attack that killed 26 people. The order demands that all Pakistani nationals on short-term visas leave India or face legal action.
