The Supreme Court declined to consider an anticipatory bail plea from AAP MLA Amanatullah Khan in connection with a money laundering case linked to purported irregularities in the Delhi Waqf Board during his tenure as chairman.
A bench comprising Justices Sanjiv Khanna and Dipankar Datta directed Khan to present himself before the Enforcement Directorate on April 18 at 11 am regarding the case.
The bench expressed concern over specific remarks made in the March 11 verdict of the Delhi High Court regarding the merits of the case and clarified that these would not influence the matter.
After his application for anticipatory bail in the case was turned down by a trial court on March 1, the Okhla MLA sought recourse from the Delhi High Court. Khan, although not listed as an accused in the recent charge sheet filed by the ED, had approached the court for relief.
In its prosecution complaint, equivalent to a charge sheet, the agency has named five individuals, including three purported associates of Khan, Zeeshan Haider, Daud Nasir, and Jawed Imam Siddiqui.
The ED stated that searches were carried out in connection with a case involving the illegal recruitment of staff and alleged improper personal benefits obtained by the accused through the unfair leasing of Waqf Board properties from 2018 to 2022, during Khan's tenure as chairperson.
The ED has reported that numerous pieces of "incriminating" material, comprising physical and digital evidence, were confiscated during the raids, suggesting Khan's complicity in the crime of money laundering.
