On September 17, the Patna High Court issued a directive to the Congress party, ordering it to remove an AI-generated "deepfake" video of Prime Minister Narendra Modi's mother from all social media platforms. The instruction was given by acting Chief Justice PB Bajantari, as reported by News18.
The controversy began when the Bihar unit of the Congress party shared the AI-created video, which showed Prime Minister Narendra Modi in a dream with his late mother, Heeraben Modi. The video quickly generated a political row, with the Bharatiya Janata Party (BJP) labeling it "highly condemnable."
The BJP also accused the Congress of "crossed all limits" and debasing the level of political discourse in the lead up to the Bihar assembly elections.
On September 13, Sanket Gupta, the convenor of the BJP Delhi Election Cell, had already filed a First Information Report (FIR) at the North Avenue Police Station in Delhi concerning the "deepfake" video. The complaint was against the video posted on the official X account of the Bihar Congress unit. According to an official who spoke to PTI, Gupta alleged that the video had "tarnished" the image of both Prime Minister Narendra Modi and his late mother.
Gupta's complaint further stated that the video had "maligned the Prime Minister's image, grossly violating law, morality and women's dignity."
The court's order reinforces the legal and ethical concerns raised by the BJP and other critics regarding the use of AI to create and disseminate misleading or defamatory content in political campaigns.
