Naidu government dissolves Waqf board, cites lack of Sunni, Shia representation

On December 1, the Andhra Pradesh government, led by Chandrababu Naidu, dissolved the Waqf Board that was set up during the previous YSR Congress Party (YSRCP) rule.
The government said in its notification that the board was “non-inclusive” and “non-functional.” An official statement mentioned that a new board will be formed soon. The Naidu administration stated that the Waqf Board has not been active since March 2023 and lacks representation from both Sunni and Shia community members, as well as former Members of Parliament.
The government also highlighted several problems, such as the appointment of junior advocates to the Bar Council category without clear criteria, which led to “conflicts of interest” with senior advocates handling cases. On November 30, the Minorities Welfare Department issued a government order reversing an earlier decision from October of the previous year. This decision had created a new 11-member Waqf Board under the YSR Congress Party, as instructed by the High Court.
Complaints were raised about SK Khaja's election as a board member, questioning his qualifications as a “mutawalli” (the person responsible for managing a waqf). Additionally, the election of a chairman had been delayed due to ongoing court cases. The Naidu government made this decision in response to protests from Muslim organisations and opposition parties, who have raised concerns about the Waqf (Amendment) Bill, 2024. The bill, which was introduced in the Lok Sabha on August 8, aims to improve the way the Waqf Board operates.
Both Muslim organisations and opposition parties, however, have criticised it, viewing it as a "targeted measure" against the community. In defence of the measure, the central government claimed that its goals were to enhance Waqf property management and streamline Waqf Board operations. The Waqf Amendment Bill, which seeks to improve the management and regulation of Waqf properties in India, is likely to be introduced during the Budget Session in February 2025, as reported by India Today TV. The bill’s introduction has been delayed because of heated discussions and disruptions within the Joint Parliamentary Committee (JPC) that is reviewing it.
