Impeachment motion filed in Rajya Sabha against justice Shekhar Kumar Yadav over VHP event controversy

A motion to impeach Justice Shekhar Kumar Yadav, a judge of the Allahabad High Court, was submitted today to the Secretary General of the Rajya Sabha. The motion was signed by 55 Rajya Sabha MPs, which is more than the required 50 MPs to file an impeachment motion.
The motion was submitted by a delegation led by Kapil Sibal, which included MPs Vivek Tankha, Digvijaya Singh, P. Wilson, John Brittas and K.T.S. Tulsi. Justice Yadav's remarks at an event hosted by the Vishwa Hindu Parishad in Prayagraj last Sunday have prompted calls for his impeachment. It is claimed that Justice Yadav's statement was "inflammatory, prejudiced, and directly targeted minority communities" in the impeachment motion.
According to the impeachment motion, Justice Yadav violated the secular ethos of the Constitution and the oath of office as a judge by using the slur "Kathmulla," saying that the country will be run according to the wishes of the majority and making remarks against the Muslim community. His claim that Muslim youngsters cannot be expected to be kind since they are exposed to animal killing at an early age was also met with criticism. The motion claimed that Justice Yadav had damaged public trust in the judiciary by making divisive and biased remarks. The judge's remarks about the Ram Janambhoomi movement are political in nature and have an impact on the judiciary's independence. "Such statements jeopardise the judiciary's role as a neutral arbitrator and protector of rights, it leads to a complete lack of faith in a litigant approaching the court with folded hands," the motion stated.
Under Articles 124(4) and 124(5) of the Constitution, along with Article 217(1)(B) and Article 218, a judge can be removed from their position if their actions harm judicial ethics, impartiality, or public trust in the judiciary. After receiving several complaints against Justice Yadav's speech, Chief Justice Sanjiv Khanna directed the Supreme Court to get a report from the Allahabad High Court on the matter.
