FIR filed against Rahul Gandhi for his 'Fighting the Indian State’ remarks

Rahul Gandhi, Lok Sabha MP and senior Congress leader has come under fire for his recent controversial remarks in which he said that "the BJP and RSS have captured every single institution, and we are now fighting the BJP, the RSS, and the Indian State itself". Because of his statement, an FIR has been filed against him at Pan Bazar police station in Guwahati.
On January 15, while addressing Congress leaders and workers during the inauguration of the party's new headquarters at Kotla Road in Delhi, Rahul Gandhi made a statement that led to registering an FIR. The FIR was filed under Sections 152 and 197(1)d of the BNS, citing "acts endangering sovereignty, unity and integrity of India," a cognisable and non-bailable offence.
Monjit Chetia, the person filing the complaint, argued that Gandhi's statement went beyond acceptable free speech and represented a significant risk to public order and national security. He also claimed that Gandhi's remarks were an effort to undermine the State's authority, potentially enabling a harmful narrative that could incite unrest and separatist feelings.
As per the FIR, Chetia said, "By declaring that his fight is against the "Indian State itself," the accused has consciously incited subversive activities and rebellion among the populace. This is an attempt to delegitimise the authority of the State and to portray it as a hostile force, thereby creating a dangerous narrative that could provoke unrest and separatist sentiments."
He also implied that Gandhi's comments were driven by frustration from his ongoing electoral defeats. As the LoP, Gandhi must uphold public trust in democratic institutions. However, he chose to misuse his position to spread misinformation and incite unrest, putting India's unity and sovereignty at risk, Chetia stated.
Further, Chetia added, "Having been unable to gain public trust through democratic means, the accused now seeks to incite disaffection against the central government and the Indian State. This behaviour is particularly alarming, given his position as the Leader of the Opposition, a role that comes with the responsibility to maintain public confidence in democratic institutions. Instead, the accused has chosen to exploit his platform to spread falsehoods and provoke rebellion, endangering the unity and sovereignty of India."
