Ex-SCBA President to Kapil Sibal over Kolkata doctor rape resolution: ‘Apologise or face no-confidence motion’

Former Supreme Court Bar Association (SCBA) President Adish Aggarwala has written to the current president, senior advocate Kapil Sibal, warning of a potential "no confidence motion" against him. This follows the association's recent resolution condemning the rape and murder case in Kolkata.
In his letter, Aggarwala expressed serious concerns about a resolution concerning the tragic rape and murder of a trainee doctor at Kolkata's College and Hospital. He stated that the resolution had not been officially approved by the SCBA’s Executive Committee, rendering it invalid.
Aggarwala also accused Sibal of using his position to diminish the seriousness of the incident and of showing a conflict of interest by representing the West Bengal government in related cases while making such statements.
“You have been representing the government of West Bengal in the related cases before Hon’ble Supreme Court. As a lawyer, you have every right to accept and argue cases. However, on August 21, 2024 you circulated a purported Resolution of the SCBA under your signature, describing the RG Kar Medical College incident as ‘symptomatic malaise’, and said the ‘resolution’ hoped that such incidents that have taken place throughout the country are not repeated,” the letter read.
“The statement about the ‘SCBA resolution’ signed by you and printed on SCBA letterhead is mischievous, dangerous, insensitive and a grave injustice to the rape-murder victim and lakhs of doctors, trainees and students who are still on protest mode, demanding safe work environment,” Aggarwala said in his letter.
The letter demands that Sibal withdraw the resolution and issue a public apology within 72 hours. Failure to comply could result in a no-confidence motion against him.
Aggarwala’s letter criticises Sibal for attempting to undermine the seriousness of the RG Kar Medical College case, which is under intense scrutiny by both the Supreme Court of India and the CBI.
Several members of the SCBA Executive Committee have also expressed concern over a resolution issued by SCBA President Kapil Sibal regarding the RG Kar Medical College and Hospital incident. They allege that the resolution, dated 21 August 2024, was signed by Sibal and circulated on SCBA letterhead without being presented to or approved by the Executive Committee.
