Delhi's Rohini Court issued a fresh summons to the BBC at its UK address regarding the banned documentary case after the previous ones went unserved.
The court has listed the matter for the next hearing on August 27.
In May 2023, the Rohini court issued a summons to the BBC following a defamation suit filed by Bharatiya Janata Party (BJP) leader Binay Kumar Singh. The suit not only targeted the BBC but also Wikipedia and Internet Archives due to their documentary on Prime Minister Narendra Modi titled 'India: The Modi Question'.
The defamation complaint, lodged by Kumar, a State executive committee member of the BJP in Jharkhand, alleged that the documentary defamed organisations like the Rashtriya Swayamsevak Sangh (RSS), Vishwa Hindu Parishad (VHP), and the BJP.
The complaint alleges that the accusations against the RSS and VHP were made with malicious intent to defame these organisations and their members. Kumar argued that baseless allegations like these have the potential to harm the reputation and standing of the organizations and their volunteers.
Additionally, the complaint contested the documentary's assertion that Prime Minister Narendra Modi was directly accountable for alleged atrocities against a specific community during the Gujarat riots in 2002, dismissing it as unfounded and defamatory.
The lawsuit sought several remedies, including a court injunction to prevent the defendants from publishing the documentary or any defamatory material concerning the plaintiff, RSS, and VHP. Additionally, it requested that the defendants issue an unconditional apology. Furthermore, it sought damages totalling ₹10,00,000 in favour of the plaintiff.
