Case filed against Amanatullah Khan over poll code violation

A case has been filed against Amanatullah Khan, the leader of the AAP (Aam Aadmi Party), for reportedly violating the Model Code of Conduct (MCC) ahead of the Delhi assembly elections. Khan, the present MLA from the Okhla constituency, was seen campaigning with a large group of over 100 supporters in Zakir Nagar on Tuesday night, which led to the case being filed against him.
The case has been filed under Section 223 of the Bharatiya Nyaya Sanhita (BNS) or the Indian Penal Code (IPC), which penalises disobedience to orders given by public servants, and Section 126 of the Representation of the People Act, 1951, which restricts public meetings within 48 hours of the time fixed for the conclusion of polling. Mr Khan is one of the candidates facing the highest number of criminal cases.
Additionally, cases have been registered against AAP MLA Dinesh Mohaniya, who has been accused of making an inappropriate gesture (a flying kiss) toward a BJP woman worker. Legal action has also been taken against family members of AAP leader Ajay Dutt, who allegedly assaulted a BJP woman worker.
On Tuesday, a case was filed against Delhi Chief Minister Atishi for allegedly violating the Model Code of Conduct (MCC) in Kalkaji. According to the police, Atishi was present with AAP supporters who allegedly obstructed an official on duty at Fateh Singh Marg. Furthermore, two AAP members were also booked for assaulting a police constable on duty.
Following the legal action, Atishi criticised the Election Commission in a post on X (formerly Twitter), expressing strong opposition to the police case filed against her. As per her claim, rival BJP leader Ramesh Bidhuri from Kalkaji and his family members openly engaged in "hooliganism," but no measures were taken against them. Instead, a case was filed against her.
Mr Bidhuri said the AAP leader was apprehensive about her "imminent defeat" and suggested that her constitutional position should not "shred the dignity."
The election for all 70 assembly seats in Delhi is taking place today, a crucial battle for AAP chief Arvind Kejriwal. The contest is a three-way fight between the ruling AAP, the BJP, and the Congress.
The Arvind Kejriwal-led AAP has dominated the last two assembly elections with sweeping victories. However, in recent years, the party has been embroiled in serious corruption allegations related to the now-scrapped liquor policy, which has put the government under intense scrutiny.
Meanwhile, the BJP is determined to regain control of Delhi after more than 25 years. The party relies on a strong campaign led by Prime Minister Narendra Modi, who has addressed massive rallies to strengthen support.
The Congress, which governed Delhi for 15 years before 2013, is also looking to revive its political influence and stage a comeback in the state.
