Allahabad High court rejects appeal against comments by Swami Rambhadracharya

The Allahabad High Court has ruled against an appeal concerning alleged derogatory remarks made by religious leader Swami Rambhadracharya about the Dalit community. The case arose after a special judge dismissed an application regarding Rambhadracharya's comments, leading the petitioner, Prakash Chandra, to seek higher judicial intervention.
Justice Saurabh Srivastava highlighted that the appeal did not substantiate any specific offenses under the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989, nor did it violate Section 67 of the Information Technology Act or any provisions of the Indian Penal Code (IPC).
Prakash Chandra filed the petition arguing that Rambhadracharya's remarks targeted the Scheduled Caste community and violated existing legal protections. However, the Prayagraj special judge had dismissed the application on February 15, 2024, due to issues related to its maintainability.
In defence of Rambhadracharya, senior advocate M.C. Chaturvedi stated that the reasoning behind the special judge’s ruling was solid. He maintained that the statements attributed to Rambhadracharya did not constitute a violation of the SC/ST Act or Section 67 of the IT Act, as alleged in the appeal. The additional government advocate echoed this sentiment, asserting that the special court's decision was legally sound.
The high court conducted a thorough hearing before announcing its ruling on October 4. After evaluating all presented arguments and evidence, the court concluded that the special judge's order should stand and dismissed the appeal.
This decision underscores the critical need for clear legal grounds when addressing sensitive issues like caste-related remarks. The court's ruling serves as a reminder that appeals lacking specific allegations under relevant laws are likely to be unsuccessful. By dismissing the case, the high court reaffirms its commitment to upholding legal standards in matters of alleged caste discrimination, potentially influencing future cases in a similar context.
